David D. McWhinnie has a broad range of experience in civil and criminal litigation. He has appeared in all levels of court in British Columbia in the conduct of cases which have included commercial disputes and claims in tort, personal injury, and municipal liability.

 

Mr. McWhinnie has appeared in the Court of Appeal on a range of cases dealing with issues including professional negligence (Perera v. De Groot), disclosure of medical records in a personal injury claim (Tennis v. Stracuzza), and importation of narcotics (R. v. Eshghabadi). Mr. McWhinnie has experience with administrative matters and with judicial review of administrative decisions, representative examples being Mendoza v. Community Living British Columbia and the “Stanley Park Six” Police Act Hearing PH 2004-01.

 

Mr. McWhinnie contributes to a number of pro bono organizations including the Law Students Legal Advice Program at the University of British Columbia, where he is a supervising lawyer, and Pro Bono BC.

 

Mr. McWhinnie enjoys boxing and regularly participates in amateur matches on behalf of a local children’s charity.

 

Mr. McWhinnie was called to the bar in 2005.
